Terms of Use
Please read these Terms carefully. They include an arbitration agreement and class action waiver that affects how disputes are resolved. You can opt out of arbitration within 30 days, as explained below.
1. Accepting these Terms
These Terms of Use ("Terms") apply to sakhaagencies.com (the "Site") operated by Nicholas K Sakha Agency Inc, doing business as Sakha Agencies ("we," "us," "our"). By using the Site or submitting a quote request, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site. You must be at least 18 years old to submit a quote request.
2. About our agency
We are a licensed insurance agency representing Allstate, with offices in Las Vegas, Nevada and Portland, Oregon. We can provide insurance only in states where we are licensed and appointed, and product availability varies by state. Using the Site, submitting a quote request, or receiving a quote does not bind, create, or change any insurance coverage. Coverage starts only when an insurance company accepts your application and issues a policy, and your policy documents control what is covered.
3. Quotes are estimates
Any quote, price, or savings we discuss is an estimate based on the information available at the time. Your final premium depends on underwriting, the insurance company's rating rules, information from consumer reports and other sources, discounts you qualify for, and your coverage choices. Savings examples on the Site are not a promise that you will save.
4. Site content
The Site provides general information about insurance. It is not legal, tax, or financial advice, and it does not describe the terms of any specific policy. Ask a licensed agent about your own situation. We try to keep the Site accurate but do not guarantee that it is complete or current.
5. Information you submit
You agree that the information you submit is true, accurate, and your own (or that you are authorized to provide it). Do not submit someone else's phone number or email. Our use of your information is described in our Privacy Policy. We never sell or share your quote request with other agencies.
6. Consent to calls, texts, and emails
When you submit a quote request and agree to the consent statement on the form, you give us prior express written consent, by electronic signature, to contact you about your insurance quote and related insurance products and services by phone calls and text messages at the number you provided, including calls and texts made with automated technology or an artificial or prerecorded voice, and by email. This consent applies even if your number is on a federal or state Do Not Call list.
- Consent is not a condition of purchase. You can get a quote by calling us instead.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to stop texts or HELP for help. You can revoke consent at any time by any reasonable means, including telling us on a call or emailing contact@sakhaagencies.com. We honor revocations promptly and no later than 10 business days.
- Only Sakha Agencies will contact you under this consent.
7. E-SIGN consent
You agree that clicking a button such as "Get My Free Quote" after reading the consent statement is your electronic signature, with the same effect as a handwritten signature, under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and state law. You agree we may provide disclosures and records related to your quote request electronically. To use the Site you need a device with an up-to-date web browser and an email address. You may request a paper copy of any record, or withdraw consent to electronic records, by emailing contact@sakhaagencies.com; there is no fee. Withdrawing consent to electronic records does not affect records already provided. Keep your email address current by contacting us.
8. Acceptable use
You agree not to: submit false or someone else's information; use the Site for any unlawful purpose; scrape, copy, or harvest content or data by automated means; interfere with the Site's security or operation; or attempt to access systems or data you are not authorized to access.
9. Intellectual property
The Site's text, design, graphics, photos, videos, and logos are owned by us or our licensors and are protected by law. Allstate names and marks belong to Allstate Insurance Company. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission.
10. Third-party sites
The Site links to websites we do not control, such as insurance company, map, and social media sites. We are not responsible for their content, terms, or privacy practices.
11. Disclaimers and limitation of liability
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent the law allows. To the fullest extent the law allows, we will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, and our total liability for any claim arising from your use of the Site is limited to $100.
Nothing in these Terms limits any rights you have under your insurance policy, under insurance laws, or under any other law that cannot be waived. This section does not apply to liability that cannot be limited under applicable law.
12. Arbitration agreement and class action waiver
Please read this section carefully. It affects your legal rights.
(a) Informal resolution first. Before starting arbitration or a court case, the person with a claim must send a written notice describing the claim and the relief requested (to us at 4765 S Durango Dr, Ste 200, Las Vegas, NV 89147 or contact@sakhaagencies.com; to you at the contact details we have). We will both try in good faith to resolve it within 30 days. All statutes of limitations and filing-fee deadlines are tolled while this informal process is pending.
(b) Agreement to arbitrate. Except as provided below, any dispute between you and us arising out of or relating to the Site, these Terms, your quote request, or calls, texts, or emails from us (including claims under the Telephone Consumer Protection Act) will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect (available at adr.org). The Federal Arbitration Act governs this section. The arbitrator decides all issues, except that a court decides questions about whether the class action waiver, the mass arbitration process, or this section's scope is enforceable.
(c) Fees. We will pay all AAA filing, administrative, and arbitrator fees for any arbitration you start, including the consumer filing fee, and we will pay them on time. The arbitration will take place in the county where you live, by video, or by phone, at your choice, or on written submissions for claims under $10,000. The arbitrator may award the same relief a court could award on an individual basis, including attorneys' fees where the law allows.
(d) Mass Arbitration. If 25 or more similar claims are filed against us by the same or coordinated counsel, the AAA's Mass Arbitration Supplementary Rules will apply, and we will pay the business share of the fees under those rules. We will not require any claim to wait for other claims to be decided before it can proceed. Statutes of limitations are tolled for all claims while the mass arbitration process is pending. You and we agree to work in good faith with the AAA to resolve claims efficiently.
(e) Class action and jury waiver. You and we each agree to bring claims only on an individual basis, not as a plaintiff or class member in any class, collective, or representative proceeding. You and we waive the right to a jury trial. If this class waiver is found unenforceable for a particular claim, that claim (and only that claim) will be decided in court, and the rest of this section still applies.
(f) Exceptions. Either of us may bring an individual claim in small claims court if it qualifies. Nothing in this section stops you from bringing an issue to the attention of a government agency, including your state insurance department, the Federal Communications Commission, the Federal Trade Commission, or your state Attorney General, or prevents those agencies from seeking relief.
(g) 30-day right to opt out. You can opt out of this arbitration agreement by sending notice within 30 days after you first submit a quote request or otherwise agree to these Terms. Email contact@sakhaagencies.com with the subject "Arbitration Opt-Out," or mail Nicholas K Sakha Agency Inc, 4765 S Durango Dr, Ste 200, Las Vegas, NV 89147. Include your name, address, phone number, and a statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
(h) Changes. If we change this section, the change will not apply to a dispute you have already notified us about.
13. Governing law
These Terms are governed by the laws of the State of Nevada and applicable federal law, without regard to conflict-of-law rules. Subject to the arbitration agreement, any court case will be brought in the state or federal courts located in Clark County, Nevada, unless the law of your state of residence gives you the right to sue there.
14. General
We may update these Terms by posting a new version with a new effective date. Changes apply from that date forward. If any part of these Terms is unenforceable, the rest remains in effect.
